Tenure and Possession
The property is offered for sale freehold with vacant possession upon completion.

Rights and Easements
The property is sold subject to and with the benefit of all rights of way, water drainage, water courses and other easements, quasi or reputed easements and rights of adjoining owners, if any, affecting the same, and all existing and proposed wayleaves and all other matters registered by a competent authority pursuant to statute.
There is an easement in respect of the land to the Environment Agency to flood land from the dam on the neighbouring land. The land has been registered and is sold with the benefit of entitlements to receive payments under the Single Payment Scheme, and its replacement, the Basic Payment Scheme which is applicable as of the 1st January 2015.
The vender has claimed the 2014 Single Farm Payment but will undertake to ensure the transfer of the above entitlements to the purchaser in accordance with the regulations of the scheme following completion of the sale providing that the purchaser is eligible to qualify for Basic Payment Scheme.
The purchaser will be required to sign an indemnification that they will maintain the land in good agricultural and environmental condition, and follow the Single Payment Scheme and Basic

The land is sold subject to a clawback of 50% to the Coal Authority which expires on the 31st December 2016.
When the Coal Authority clawback terminates the land will be subject to a further clawback of 50% for a term of 25 years from the date of termination of the Coal Authority clawback to the benefit of the vendor and their successors in title triggered by the sale with or implementation of planning permission for any uses other than agriculture, forestry and equestrian.
